Family Mediation

Parties will meet with a family mediator who will help them facilitate negotiations based on issues both parties wish to resolve. Parties involved in mediation are in control of the outcome. The mediator will help guide and facilitate parties in a neutral manner to reach resolution.

Family Mediation-Arbitration

This a two step process. Parties will first meet with a family mediator with the goal to resolve their disputes together in mediation. Should parties be unable to resolve all of their issues in mediation, whatever issues are remaining in dispute, will go into the second step, arbitration.
This is when an arbitrator will step in, listen to all evidence presented and make a final binding decision.

Family Arbitration

Family arbitration is essentially hiring a private judge to make final and binding decisions for all outstanding family law issues in dispute with you and your former partner.
In arbitration, both parties present their case to the arbitrator by telling their story and presenting evidence, and when suitable, witnesses. Each party is given the chance to hear and respond to the others case.
Both parties must receive independent legal advice prior to signing an agreement to arbitrate.
After hearing both parties cases, the arbitrator will make a decision, called an award. An arbitration award is a final and binding decision. Just like the Ontario court system, the parties do have some rights to appeal an arbitration award.

Detailed parenting plans

A parenting plan is a written document that outlines in detail how parents will take care of their child(ren) post separation. This document is usually inclusive of custodial rights of parents, access schedules, where the children will reside and when, child support, holiday schedules, extracurricular activities and how they will be paid for, and parental communication. This plan can be as detailed or as flexible as the parents wish it to be.

Divorce Applications

All of our mediators and arbitrators have direct family court work experience. They are all well versed and able to help parties file for either a joint divorce, or a simple divorce. The only way to become legally divorced in Ontario is through an application in court. A lawyer, mediator or arbitrator cannot grant a divorce.

Equalization Payments

When a couple separates, the spouse with the higher Net Family Property Usually will pay the other spouse half of the difference. An equalization payment, and division of property can be very intricate and should only be handled by professionals trained in the field. Assets usually considered in an equalization payment can include property, investments, pensions and bank accounts.

Memorandum Of Understanding

At the end of a mediation, you and the other party may come to an agreement on all or some of the issues in dispute. Our mediators will draw out a detailed document, in which all details of your agreements will be documented in great detail. Parties can chose to follow their agreement through this document, they may wish to submit the document into court and ask it become a court ordered document, or they may chose to have this drafted into a legally binding separation agreement. Parties are strongly advised to receive independent legal advice to review this document prior to having it translated into a legally binding document.

Child Consulting

Family separation is a difficult time for children and having no control over decisions made by their parents can cause greater upset. Children being able to talk to someone outside of the family allows the opportunity for them to express their views, worries and feelings without the fear of upsetting parents. The child consultant will share the voice of the child in mediation. This allows parents to make informed decisions reflecting their family’s unique needs. Child consultants are only appropriate in certain cases. Our child consultant holds a Master of Social Work degree, and will meet with parties to determine whether this process is appropriate.

Domestic Violence Screening for other practitioners

Prior to entering into a mediation or arbitration, parties must be screened for domestic violence and power imbalances. This ensures that our staff are able to conduct a safe and appropriate process for all parties involved. At eye to eye, all of our staff have intensive training on how to conduct this crucial process.
Independent arbitrators are not allowed to conduct their own screening process for clients.
In addition, we offer domestic violence screening for practitioners who by-law cannot conduct this safeguard themselves, as well as for mediators and lawyers who wish to have expert screening done for them.
